Governing your use of all Root & Rise programs, products, and community spaces.

These Terms of Service ("Terms") govern your access to and use of all products, programs, digital content, courses, memberships, and community spaces offered by Root & Rise Sensory Solutions LLC ("Root & Rise," "we," "us," "our"), operated by Melissa Summers in Wheat Ridge, Colorado. By purchasing, accessing, or enrolling in any Root & Rise offering, you agree to be bound by these Terms.

Please read these Terms alongside our Educator Disclaimer and Privacy Policy, both available at rootandrisesensory.com.

1. Our Programs and Products Root & Rise currently offers the following: •Free Intro Video to get started, available at rootandrisesensory.com • Sprout Toolkit — $37 digital product including a grounding video and sensory first-aid toolkit • Seedling Course — $197 self-paced video course covering the full S.O.I.L. framework • Taproot Intensive — $1,600 eight-week 1:1 parent mentorship program • The Greenhouse — $97/month private membership community (open to Seedling and Taproot graduates only)

All offerings are educational in nature and are delivered through Kajabi, our course and community platform. Nothing offered by Root & Rise constitutes occupational therapy or any clinical service. See our Educator Disclaimer for full details.

2. Eligibility Our programs are intended for parents, caregivers, and educators of children. You must be at least 18 years old to purchase or enroll. The Greenhouse membership is available only to individuals who have completed the Seedling Course or the Taproot Intensive.
3. Purchasing and Payment All prices are in US dollars. Payment is processed securely through Kajabi's payment system. By completing a purchase, you authorize the charge to your payment method. For The Greenhouse monthly membership, you authorize recurring monthly charges of $97 until you cancel. You may cancel at any time through your Kajabi account settings.

Refund Policy • Sensory Lens Video Free. No purchase required. • Sprout Toolkit: No refunds on digital downloads once the product has been accessed. • Seedling Course: 14-day refund window from date of purchase, provided less than 20% of the course content has been accessed. After 14 days or after 20% access, no refunds are available. • Taproot Intensive: A $200 non-refundable deposit is due at booking to hold your space. If you cancel before your first session, the remaining balance will be refunded in full. No refunds are available after the first session has taken place. • The Greenhouse: Cancel anytime. No partial-month refunds. Your access continues through the end of the current billing period.

4. Intellectual Property All Root & Rise content — including but not limited to course videos, worksheets, PDFs, slide decks, email sequences, the S.O.I.L. framework, the Daily Sensory Practice methodology, program names, and community content created by Root & Rise — is the intellectual property of Root & Rise Sensory Solutions LLC and Melissa Summers. All rights reserved.

Your purchase grants you a personal, non-transferable, non-exclusive license to access and use the content for your own family and household purposes. You may not: • Share your login credentials or grant access to any other person • Reproduce, distribute, resell, publish, or publicly display any Root & Rise content in any form • Use the S.O.I.L. framework, program materials, or any Root & Rise content as the basis for your own paid programs, courses, or services without prior written permission from Melissa Summers • Screenshot, record, or capture any live session content for redistribution

Root & Rise will pursue appropriate legal remedies for unauthorized use or distribution of our intellectual property.

5. Community Standards — The Greenhouse The Greenhouse is a private, graduates-only community hosted on Kajabi. It is a space for parents who have completed the Seedling Course or Taproot Intensive to continue applying the S.O.I.L. framework with community support and monthly access to Melissa via live Q&A calls.

By joining The Greenhouse, you agree to: • Engage with all members with kindness, respect, and good faith • Stay in the parent educator lane — share your own observations and experiences, and avoid offering clinical interpretations of other members' children • Keep member-shared information confidential within the community • Not promote, advertise, or solicit for any outside product, service, or business without written permission from Root & Rise • Not share, screenshot, or redistribute content posted by other community members without their consent

Root & Rise reserves the right to remove any member from The Greenhouse at any time for violations of these standards. Removal for cause does not entitle the member to a refund of any membership fees paid.

6. Copyright Infringement & DMCA Policy Because The Greenhouse community allows users to post content and share resources, we comply with the Digital Millennium Copyright Act (DMCA). If you believe that any content posted by a user in our community spaces infringes upon your copyright, please notify our Designated Agent in writing at [email protected] with the following information:

1. A physical or electronic signature of the copyright owner or authorized representative.
2. Identification of the copyrighted work claimed to have been infringed.
3. Identification of the material that is claimed to be infringing and where it is located in our community.
4. Your contact information (address, telephone number, and email).
5. A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
6. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.

Repeat Infringer Policy: In accordance with the DMCA and other applicable laws, Root & Rise maintains a policy of terminating, in appropriate circumstances and at our sole discretion, the access and accounts of users who are deemed to be repeat copyright infringers.

7. Disclaimer All Root & Rise content is educational. Nothing we offer constitutes occupational therapy, medical advice, clinical assessment, diagnosis, or therapeutic treatment. See our full Educator Disclaimer at rootandrisesensory.com for complete details.
8. Limitation of Liability and Indemnification TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ROOT & RISE SENSORY SOLUTIONS LLC AND MELISSA SUMMERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF, OR INABILITY TO USE, ANY ROOT & RISE PROGRAM, PRODUCT, OR COMMUNITY. OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR OUR PROGRAMS SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO ROOT & RISE IN THE TWELVE MONTHS PRECEDING THE CLAIM. THIS LIMITATION OF LIABILITY DOES NOT APPLY TO DAMAGES ARISING FROM GROSS NEGLIGENCE OR WILLFUL MISCONDUCT.

• Indemnification You agree to indemnify, defend, and hold harmless Root & Rise Sensory Solutions LLC, Melissa Summers, and any contractors or affiliates from and against any legal claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your breach of these Terms; (b) your violation of any law or the rights of a third party; or (c) your unauthorized use, sharing, or distribution of Root & Rise intellectual property or educational content.
• Changes to These Terms Root & Rise may update these Terms from time to time to reflect changes in our programs, legal requirements, or business practices. We will notify active clients of any material changes via email at least 14 days before the changes take effect. Your continued use of our programs after that date constitutes your acceptance of the revised Terms.

Governing Law and Dispute Resolution

• Governing Law These Terms are governed by the laws of the State of Colorado, without regard to conflict of law principles.
• Mandatory Binding Arbitration By purchasing or using any Root & Rise offering, you agree that any dispute, claim, or controversy arising out of or relating to these Terms, your purchase, or your use of our programs shall be resolved exclusively through mandatory, binding arbitration, rather than in court. The arbitration shall be conducted in Jefferson County, Colorado, or remotely, in accordance with the rules of the American Arbitration Association.
• Class Action Waiver You and Root & Rise agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to bring a claim against Root & Rise as a plaintiff or class member in any class or representative legal proceeding.
